Buying property in Rishikesh: a guide for outside & NRI buyers
Important: This page is general information, not legal advice. Laws, limits and procedures in Uttarakhand change from time to time. Always verify the current rules and every document with an independent property lawyer before you sign or pay anything.
1. Understand land-use and buyer eligibility
Uttarakhand has specific rules on who can buy which kind of land, especially agricultural and horticultural land, and these differ for residents and non-residents of the state. Rules for residential plots inside municipal limits, apartments and commercial property may differ from rules for agricultural land. Ask your lawyer to confirm, for the specific property, whether you are eligible to buy it and whether any permission is needed.
2. NRIs and foreign citizens
NRIs and OCI cardholders are generally allowed to buy residential and commercial property in India, but there are restrictions on agricultural land, plantation property and farmhouses under FEMA. Payments usually have to come through proper banking channels (e.g. NRE/NRO accounts). Foreign nationals who are not OCI/PIO face stricter limits. Confirm your own position with a lawyer and your bank.
3. Documents to check
- Title deed / sale deed chain and ownership history
- Khatauni / mutation records showing the seller as owner
- Encumbrance status (no loans, disputes or liens)
- Land use / zoning, and whether the land is in a forest, eco-sensitive or riverbed-restricted zone
- Approved map / building plan from the competent authority for built property
- RERA registration for projects that require it (check on the Uttarakhand RERA portal)
- Up-to-date tax and utility bills
4. Site checks
- Measure the plot on site and match it with the documents and boundaries.
- Check approach road width and whether it is a public road.
- Ask about water, electricity, drainage and monsoon flood or landslide risk.
- Speak to neighbours about any disputes.
5. Paying and registering
Use traceable bank payments and keep a written agreement for any token or advance. Stamp duty and registration charges are set by the state and can change, so get the current figures from your lawyer or the sub-registrar office. Registration happens at the relevant sub-registrar office, and mutation in your name should follow.
6. How we help
We help you shortlist properties, arrange site visits (in person or by video), collect documents from sellers and coordinate with your lawyer. We do not give legal opinions. Your lawyer should do the final verification.
